Are might and magic series 1-9 copyrighted?

The role-playing games (I-X) that started it all and the various spin-offs (including Dark Messiah).

Yes, Ubisoft holds their copyright.

I think the name "Might and Magic" is copyrighted

I would really like to see some remakes or the earlier games... most noticeably might and magic 1-5... but yeah, Ubisoft holds the copyrights on the series and I haven't seen much... just like how the Ultima series isn't held by it's original creator anymore...

But I believe that you can remake to your heart's content, as long as you don't use the original assets.

Ubisoft has the entire back catalogue on everthing 3DO owned named "Might and Magic". All the games are still bound to that copyright.

However, I'm wondering whether Ubi has rights to two of 3DO's pseudo-Might and Magic games: Shifters and Dragon Rage. These two have many elements from the MM series, but their names aren't tied to its intellectual property, or any for that matter.

Agree, as long as the project is not made for proffit
should be no problems with copyrights, many fun/tribute
games out there done with the same way and most(but
not all) din't have problems. And if you have...change the
name, like Might with Magic...haha, or tricks like this, MnM
funs will always know anyway :P

Depending which country you live and many other things.
In my country, any project created in "Reseach, study purpose" is leagal, even if it uses someone's intellectual property,

And it's always legal if it's for personal use only, that is, if you don't plan to release it, but where's the fun in that? :D

There are 2 active projects that make entirely new MM games (WoX2, MMTNO) and 1 that seems inactive (MMT). That's not counting projects based on MM6-8 engine. So, I don't think it is a good idea to start another one.
My patches: MM6 MM7 MM8. MMExtension. Tools. Also, I love Knytt Stories and Knytt Underground. I'm also known as sergroj.

So WoX 2 is still active? That's good to hear.

It's a Russian remake of MM. They started first, but almost weren't heard of since their first demo. This year they've posted some impressive screenshots, the engine has been redone from scratch AFAIR. Here are some: http://www.picatom.com/1j/wox2screens-1.html
They are soon going to release the new demo.

Will there be an english translation for this remake of Might and Magic? (Is it a remake of Might and Magic 4 and 5 - World of Xeen?)

No, in fact it's not, they just chose the name because they liked the "world" part of it. At least that's what was written in the old website.
